Military Parole in Place (PIP) Visa Petitions

What is Parole in Place (PIP)?

Parole in Place is a special provision that allows certain family members of U.S. military personnel (active or veterans) who are already in the United States without a lawful immigration status to stay. With PIP, they can apply for a green card without leaving the U.S., even if they entered the country without inspection.

who might be eligible for pip?

You might qualify for PIP if you are:

  • The spouse, parent, or unmarried child under 21 of a current or former U.S. military member.
  • Present in the U.S. without a lawful immigration status.

main benefits of pip

  • Receive a legal status called "parole" which allows you to stay in the U.S. temporarily.
  • Apply for a green card from within the U.S., without facing penalties for prior unlawful presence.
  • Avoid the need to leave the U.S. to attend a visa interview at a consulate abroad, which could result in long separations from family or potential entry bars.

how does the pip process work?

  1. Submit an application to U.S. Citizenship and Immigration Services (USCIS) with evidence of your relationship to the U.S. military member and proof of their service.
  2. If USCIS approves the application, you receive "parole" status.
  3. With "parole" status, you can then apply for Adjustment of Status to become a permanent resident (get a green card) from within the U.S.

remember

Parole in Place is a discretionary relief, meaning it is granted on a case-by-case basis. It is essential to understand the requirements and provide a well-prepared application. If you believe you might qualify for Parole in Place or have questions about this provision, reach out for a consultation.
