Fiancé(e) Based Visa Petitions

What is a Fiancé(e) Visa?

A Fiancé(e) Visa, also known as the K-1 visa, allows the foreign fiancé(e) of a U.S. citizen to enter the United States with the purpose of getting married.

Who can sponsor a fiancé(e)?

Only U.S. citizens can sponsor their foreign fiancé(e) for a K-1 visa.

what are the main requirements?

  • The U.S. citizen and the foreign fiancé(e) must have met in person within the last two years.
  • Both parties must be free to marry (any previous marriages must be legally ended through death, divorce, or annulment).
  • The intention must be to marry within 90 days of the fiancé(e) arriving in the U.S.

how does the process work?

  1. The U.S. citizen (the petitioner) files a petition with the U.S. government to sponsor their fiancé(e).
  2. If the petition is approved, the foreign fiancé(e) attends an interview at a U.S. embassy or consulate in their home country.
  3. If granted the visa, the foreign fiancé(e) travels to the U.S. The couple must then marry within 90 days of the fiancé(e)'s arrival.
  4. After marriage, the foreign spouse can apply to adjust their status to become a permanent resident (green card holder).

Benefits of a Fiancé(e) Visa

  • It allows couples to be together in the U.S. while planning and holding their wedding.
  • The foreign spouse can apply for a green card after marriage.

remember

The Fiancé(e) Visa has specific requirements and timelines that must be followed. It is essential to get legal advice to ensure a smooth process. If you are considering sponsoring your fiancé(e) or have questions about the K-1 visa, please reach out for a consultation.
